I would like to introduce myself I am Mr Behram Sethna . I had booked a KTM 390 in Sept 2013,


Finally on 29th November 2013, the two wheeler  was delivered at 12:20 p.m.   Upon taking the Test Ride it was noticed and clearly heard a very distinct, squeaking and cracking noise from the main engine. It was immediately brought to the notice of Mr. Nilesh Tailor the showroom personnel, at first he simply refused to accept that there was any such noise emitted by the engine but on further insisting refusing to take the delivery of the two wheeler he agreed to the noise. He actually forced us to take the delivery of the vehicle even with the loud disturbing engine noise and very conveniently he told us its some small PDI (pre-delivery inspection) issue.


Then he front of us he called up some Service Station in Kandivili and requested us to take the said vehicle on 2nd December 2013 on our expenses to get it checked and sort out the problem. All the while just insisting and forcing us to take the delivery of the vehicle. Insisting as it’s a very minor issue and will be sorted out the Service Station. At the Showroom also when the keys were handed over to us, the bike didn't start at the very first go and upon repeated attempts by the said personnel he finally managed to start the vehicle stating the problem as low fuel level.


When the Test Ride was taken it would jerk and come to a stand still and refuse to start again. We agreed to his demand of taking the bike to Kandivili Service Station for inspection to resolve the problem. Finally with no option at hand we were forced to take the delivery of the vehicle.  No proper pre-delivery instructions as to various functions of the vehicle was given to us.


That very day after getting the bike home it was not used as we had a  ceremony to be attended.  Next day i.e. 30th November 2013 being the same the bike was not used except for a few rounds on it with the kids even then during the initial start of the engine it never started on the first attempt, only after repeated attempts, managed to get it started and running.


The bike on starting would just heat up on idling and the gauge would display from cold to hot in a matter of few seconds. Once started with my kids on the bike the bike starts and while riding the bike on a slow speed of 30 to 40 kms. it just stalls on the road, lucky being on the internal society road, there is not much of traffic.  After the stall of the bike while riding it I just stopped taking my kids for a ride on it as it was a danger to their life as well as mine, if such a thing were to happen on the main road with heavy traffic which would lead to a serious accident and even death. But on 1st Dec. 2013 inevitable did happen.


As my wife and me were on the bike riding at 30 to 40 kms per hr. on our way to town  the bike came to a screaming halt and stalled. The whole engine got locked. I some how managed to control the bike. That area being main traffic spot lot of speeding vehicles, it was very life threatening experience for both of us. If it wouldn't be for the sudden braking of the car behind us, we would not be alive today to tell this tale.
