What is common to Bappi Lahiri and the Beatles? Both have been accused and acquited under copyright violations

Bappi Lahiri infamous Kabhi resham lagta hai from the movie asha, was used as an sample in a R&B mix by a american rap group called Truth Hurts . they recently lost a action suit against Mr. Lahiri

Its a different story that our Mr. Gold Ki Dukan has been lifting tunes, left right and center

Thats what I dont like about copyrights, it gives a unfair right to the person who creates it to subjugate all sorts of restrictions on others

DId somebody copyright the vedas, the bible, aesop fables . no . so why have copyrights

the basic idea of copyright does not flow from the general law of protection of rights, but from protection of ones livelihood hence emphasis is laid on the uniqueness of the item to be copyrighted.

Copyrights are ad infinitum once copyrighted and cannot be transfered under the normal laws of inheritance.

With the post GATT world scenario, it is important for india to wake up to being aware of these legislations for their better . like Mr. Lahiri, its a different matter, the US record companies will come cracking on the WESTERN INSPIRED Indian so called'Music Directors' shortly
