You need to follow the steps given below -

  1. Lodge an online complaint at this site - https://ccccore.co.in/ You can lodge the complaint against the Proprieter of the business that wronged you. Core.nic will issue them notice to sort out the issue amicably with you. If they do not respond, core.nic will issue another notice. (You may have to follow-up with core.nic folks for this)

  2. Take copy of core.in complaint and issued notices and file a case with district consumer court. Address of Hyderabad district court -

People there are very helpful, they will give you the draft to file the complaint, you just make your complaint on the similar lines. Attach photographs (if applicable) of the goods and the Receit. A formal consumer court case will begin at district level. It took us about 4-5 hearings and the case was decided in our favour. We did not hire any lawyer and faught our case ourselves.

Business owner was asked to return our entire amount and also the litigation charges.

Feel free to write to my M2M inbox for any guidance. We are educated folks and we can't let business owners take us for granted. Let us help make the Indian businessman more accountable.

8th March 2010 -

Finally, 14 months after filing the complaint, we got our money back. Rs.45,000/- for the sofa and Rs.3000/- as litigation cost. The justice could have come a little earlier but for the recent political disturbances in AP. Finally, all is well that ends well :)

Apart from the process written above, we had to take two more steps to get our money back -

  1. The opposite party (business owner) filed an appeal in the state court against the judegement passed by district court. But state court upheld the decision and rather added Rs.2000 more to the litigation cost.

  2. We had to request cosumer court district forum to get the payment orders executed. Court issues warrant against the owner and finally, the owner paid up the entire amount.

So, after about 10 more hearings and a lot of patience, we got our money back!
