Getting call from Fake agents sending you "Legal notice from Tis Hajari court "?
1) Most important thing ask them do not call send mail via company official mail. I bet they would not do so.
2) Verbal harassment is very difficult to prove in court against any party, So companies like these take benefit of this and call you and scare you with all these nonsense.
3) Before filing a case a official notice needs to be sent to the other party, if some one is calling and telling you he is sending a warrant(warrant is more scary word for innocent consumers) means he is fooling and pressurizing you. If they dont send notice and directly file a case then this will automatically weakening their case and would be treated as act of harassing consumer.
4) Remember no lawyer is free to call individual party and talk this nonsense. These are all their fake agents who call from their personal numbers so that no one can blame company.
5) If you have taken services at your office or residence then the jurisdiction is local court not Delhi.
6) If you find that you are clear from your side and you have all records with you so being consumer you have more rights then any service provider. Most of the people scarred with the name "Legal Notice", "Court" etc. Don't get scarred, this is companies policy to pressurize you to get the amount from you.
7) In my case I requested them to do not call me send me so called "Legal notice or Warrant, but they did not sent me till date, I am waiting since months for the notice so that I can take this issue to the court and teach this company a lesson so that it would stop harassing poor consumer.
8) More importantly a notice does not mean you would be sent to jail of directly hanged:-), if you receive notice from a ISP(which is very rare) be calm and check if you can get some legal advice from some portal. Wait and think for a minute Maximum what can be done?, the amount company is claiming, would need to be paid by you? but is that so easy? When third party ie. honorable court comes in middle they all are for helping consumer and their rights. And would you spend Rs 5000 in court to just recover Rs2000, companies are not stupid to shell out 5K to recover 2K? Company is more smarter then you.
9) Remember a legal case against anyone is a expensive, time consuming and lengthy procedure and no one want to indulge into it. A consumer has more rights then a service provider. If you loose it is just one person in thousands but if company looses, it involves their reputation, goodwill and proven bad record in front of court.
10) At last even you receive a legal registered notice from court(which is very very rare) and you do not want to involved in court matter, just call the customer care and tell them you want settlement. They will send some one and settle the matter out of court. Which is the mostly end story of all these kind of issues.
