I was shocked to read a news in local newspaer that if the National Aids Control Organisation approves , the government is going to abolish the section 377 of Indian Penal Code in which is a homosexual or lesbian couple is caught red handed will be punishable under this act and an imprisonment for 7 years is liable.
What is this organisation, the name I have heard first time and who had authorised to play a decisive role in recommendation to government to allow abolition this section377. An NGO filed a case before Hon'ble HIgh Court of Judicature,Allahabad and rightly accepting the petition of an NGO, it has rejected the petition saying that in the Indian Society it is not acceptable.
Now this has been put before Hon'ble Delhi HIgh Court. Sabhar HIndustan Dated 21.07.2006.
Where as my personal opinion is concerned I feel that really our society which is entirely different from Europian countries, is and will never be accepting same sex relation be made legal.This will create many law and order problem in our country, as our society is not mentally prepared since the inception of our culture. I am not saying that same sex relationship is not existent in India, but people do it behind dark glasses of room. In fact this is as old as prostitution is the oldest profession for which people says that if even a single prostitute, call girl is removed, our ladies in the home and in society will be safe. The reason behind this is given that man has basic animal instinct. But even then our society does not accept it.
Dear viewers, this is our this society where son do not dare to smoke or drink before his father or mother becuz unlike foreign europian society, in a family,members do really love respect and take best care of their children and those children also reciprocate the same respect to their elders. And Government and others should also know that our 77% population lives in rural areas and rest lives in cities. If we count the population living in Metros or Cosmost, will come aroud 20%.
Even we read in News Papers local village Panchayats give death punishment to couples of intercaste marriage or for any illegitimate or extra marital relationship.
Although I have given my personal opinion about on which I stick strictly but, if I loose another end,will be injustice.
In ancient Rome Homo Sexuality or Lesbian was a nothig abnormal and kings were keeping their male lover. Like wise in many western europian countries, this is prevelent from long back. Even then I insist that our society is entirely different on socio,religeous and other factors and it is not permissible.
If I go to root cause and try to know what are the factors leading to ths type of relationship, I will found that there are two types of persons who have this tendency or relationship'
First are those who are born with the same sex attraction and till the age of their sex identity realisation of self , they find it that they have it from their childhool or birth. These type of people are just helpless and nobody can cure them, except their sex change thru surgical operation. But this is a long process as the particular person male or female has to live under the supervision of the Surgeon and a team of psychologists. They keep them under observation and give their report to the surgeon whether that person is psychologiclly fit to live in the society, after sex chage. In that case there also, there is legal problem that he or she has to change their education certificate to the new name.But the surgeon gives the certificate which is valid all over world about the sex change.
2.Secondly there is a case where the person male or female are not attracted to same sex attraction but some infuluentaial persons use those children for their sex lust. This is the crime under sectio 377 of IPC, which must prevail.
To sum up I do not favour UPA government's effort to legalise same sex relationship in India. And if this happens big law and order, social problems will start and may happen that these types of boys and girls may be expelled from their home and society. Also this may cause lot of embarrassment to their parents.
