I have purchased Maruti Suzuki Echo from you dated 4/10/2011 invoice no.(as per rec.). At the time of purchase of the vehicle from you in the Bill you have mentioned certain charges which includes ‘Extended Warranty Charges’. However, at the time of booking you have told me that ‘Extended Warranty’ will be given to me without any charges.
Thereafter, I have communicated to you for rectification in the said Bill and refund of the amount charged by you from me under the head ‘Extended Warranty’.
Thereafter, vide Bill No._(as per rec.)_ dated_(as per rec.)_ you have accordingly rectified the error and instead of ‘Extended Warranty Charges’ you have mentioned there ‘Handling Charges /logistic /scottyard charges’, which charges you have not mentioned me at the time of purchase that you will charge them from me.
that me on careful examination of the invoice no._ dated_issued by you found that a sum of rs.4600 towards “Handling /LOGISTIC scottyard CHARGES “ was illegally charged and collected by you from me.
that I approached you to find out the rationale behind levying and collection of logistic charges, but due to my dismay found that you did not give any plausible reason for levying and collecting logistic charges /handling/scottyard charges.
that I thereafter came across a PUBLIC NOTICE in leading newspapers of Delhi clearly indicating and intimating the general public at large, not to pay anything extra other than the charges and fees prescribed and authorized by Transport Department .
that it is a matter of record that the motor licensing officers of the concerned zonal office issue of renew trade certificate of car/scooter dealers in form no.17 as per rule 35(1) of CMVR. The motor licensing officers while issuing the trade certificate places a condition in the said trade certifiacate that thedealer would comply with CNVR/MV act, administrative orders you not to charge anything extra from the customer .however, the dealer would be authorized to collect taxes and fees payable by the customer to you. Though the said condition is imposed on the dealer by the motor licensing officers of you but they never cross check, whether the dealers are adhering to this condition scrupulously and deliberately ignore to check, for reasons best known to them.
that it is a matter great shame and regret that the officers posted at the zonal officers do not exercise due diligence, being recipient and custodian of files submitted by dealers, as this scrutiny could be done at the threshold itself. The foremost duty of the motor licensing officers is to see that the dealers comply with various provisions/section of CMVR/MV act, administrative directions issued by you and to safeguard the interest of the general public. On the contrary the motor licensing officers abet dealers /you to collect illegal charges, inter-alia, from me by willfully and deliberately not scrutinize the invoice raised and issued by the dealer, thereby the corrupt motor licensing officers get their share of the booty. To recapitulate a white collar crime is being committed day in and day out and ill-gotten gains are shared amongst senior officers /officials of you.you are well aware of the fact that their authorized dealers are charging logistic charges from their customers but remain silent and also violate the terms and conditions entered with you.
In view of the facts and circumstances mentioned herein- above, I call upon you to refund a sum of rs.4600 illegally charged and collected from me along with interest of 2 24%. I further call upon you to issue appropriate administrative orders to all dealers who have been issued TC / self registration powers to stop such illegal charges being levied and collected or those indulging in unfair trade practice by cancelling their trade certificates forthwith. Please take notice that in case logistic charges along with interest is not refunded by you, or you fails to issue directions forthwith to dealers indulging in violating CMVR/MV act .
It is, therefore, requested to you that the charges mentioned in the Bill No._(_as per rec.)_ dated_(as per rec.)_ which have been paid by me as ‘Handling Charges/logistic /scottyard charges’’ to you may please be refunded to me at the earliest .
I assure quick and remedial action from you.
