Unilateral Cancellation of Customer Order. Review on Indiatimes

I had ordered for Nike Sports Shoe (size 09) order no 3002511058 on 12 Jul 2013 by paying full amount at Indiatimes Shopping online portal, my order and size of shoe was confirmed by Indiatimes shopping through mail/online chat on 12 & 13 Jul 2013.  I received a courier on 20 Jul 2013 (labeled Nike Shoes Size 09), on opening of the packing, to my utter shock the shoe delivered was size 10. The product was similar to a rejected piece which normally company’s offer at discount prices in seconds sales.

I had complained (No 990630) regarding same through mail to IndiaTimes Shopping on 20 Jul 2013. The product got return picked up (AWB 3751466611) and I was given date 14 Aug 2013 as date of resolution of my complaint.  Having lost faith in Indiatimes Shopping, I use to enquire status of my complaint on daily basis through mails/chats/telecalls to Indiatimes Operation Head, Customer Service, all the time I was assured of delivery of the right product before 14 Aug 2013.

After receipt of my full amount and sitting of the complaint for more than one month, to escape from resolution of complaint, Indiatimes Shopping cancelled my order unilaterally. Even today the product and the size is available for sale on the portal at the below link

How can Indiatimes Shoppinng can cancel my order unilaterally and decide fate of the order ? Being a Times of India group company this kind of  irresponsible, undesirable, unreasonable and unwarranted act seems to be one in haste having no sanctity to the consumer rights. The Indiatimes shopping is not sheer profiteering entity rather it is for some specific purpose for convenience of the netizens of the Union of India who are at large the valued customers.

I advice online shoppers be aware of the malpractices and mischief's of Indiatimes Shopping before you place an order.  This is a big scam going on with the Indiatimes shopping portal,  they hold your money to do their business, earn profit out of it and thereafter simply they cancel your order unilaterally with/without your consent. These acts of Indiatimes shopping amounts to deficiency of service and unlawful trade practice as per consumer protection act 1986.

The worst part is that you can't  file any case against Indiatimes shopping locally. Since the disputes have be filed with in jurisdiction of courts of New Delhi, I am getting in touch with NGOs fighting for consumer protection acts and also lawyers regarding the same.
