E-bay cheated by selling iberry tablet to me

I purchased a new iberry Auxus AX03G tablet + phone android ics 1gb ram 24gb 1yr mfg wrnty (#130725425123)from ebay on 10-07-2012 and paid rs 9999.00 using my credit card. I received the item on 25-07-2012.(Ebay had updated in the site by themselves that I had received the item on 24-07-2012, they DID'nt waited for my confirmation of receipt of the item that I had paid for.) On receipt of the item I released that the product I got is not as described. Immediately I contacted the seller by email on 29-07-2012. He refused to give a refund for the product and asked me to contact the manufacturer directly for any complaints. The sellers behavior was against the ebay guarantee(http:/Pages.Ebay.In/Aboutebay/Ebay_guarantee.Html).


As the seller have not provided me with any bill or even address I was not able to ship back the product for claiming refund. On 30-07-2012 I opened a case against the seller and requested e-bay to provide me the address to which I can ship the item back. I got a mail from ebay on 04-08-2012 stating that "since you have raised a claim on 30-jul-2012 and the claim ID (109560). Minimum time the claim adjuster take to investigate and reply is 7 from the date of claim filed and maximum 20 days." Since there was no response from e-bay or the seller after that on 10-08-2012 I submitted the claim on e-bay on 10-08-2012 for which I had received a response from e-bay that "within 7 days, ebay will email you with further claim instructions". However I have not received even a single communication from e-bay after that.


I had sent mails to e-bay customer support on 07-08-2012, 09-08-2012, 04-09-2012 , 10-09-2012 for which no response is provided by ebay. By not providing me with the address of the seller e-bay had breached the contract between me and ebay as a service provider. By not responding to my mails e-bay had caused me mental agony.


As no support was received from ebay and the seller iberry_estore (tablet_estore) , kamaraj kamaraj 9171542736, valueiideals@yahoo.Com I tried to get the tablet in a working condition by taking it up with the manufacturer. On 09-08-2012 I opened a ticket in iberry website(http:/Support.Iberry.Asia/View.Php?ID=634833)(email ID: abinpjose@gmail.Com). Initially they asked me to download the firmware of the product and reinstall the firmware. However the same was not helping. So I decided to deliver the product for service repair under warranty on 01-09-2012 at the manufacturer address as stated in their we site.

However on reaching the shop no.8, no4, second line beach, chennai-1 there is the shop micro sys, he( P. Umapathy) informed me that his shop dont have any collaboration with iberry. The iberry representative will come every day evening and collect the tablets for repairs and he is mearly a seller and he just coordinates for the sale. The address of iberry as stated in their website( http://www.Iberry.Asia) is of micro sys. This means that without providing a proper address the company is entered into e commerce business by providing fake address to their buyers. And for the tablet that is given for service no receipt or any documentation is provided. However on 08-09-2012 I collected the tablet back after intimated by the store(I called up) that item is ready. At the shop while collecting they informed that as there is no good network inside their building I would not be able to check the status there. However even now the tablet is not detecting any network. This product is not worth for rs 10, 000.00


Sir my concern is that e-bay is still selling this product and you can verify by the negative feed back and comments received for the item 130725425123 and for the seller tablets_estore

  1. E-bay had cheated me by not providing an opportunity to state that I haven't received the item I had paid for.




2.By refusing to provide me the address of the seller, e-bay have not honored the ebay guarantee policy


3.The seller by refusing the refund claim acted against the listings before sale.


4.The seller had cheated me by selling the product not as stated and described.


5.The company ibeyy india have published a fake address in their website and doing commercial business.


6.Though I paid money I have not provided with a vat paid bill or receipt for the item.


7.By not servicing the table and by not responding iberry is not honoring the 1 year manufacturer guarantee.


8.Though it is noticed to ebay by mail that the seller is cheating the buyers by not providing the bill/Invoice and also selling sub quality products no action is taken by ebay.


9.While posting about the cheating in e-bay discussion forum their moderators deleted my post and sent me threatening mail stating that they will suspend my account.


It is now 50 days since i had opened a case in ebay. Till now no one had called me. When ever i was able to reach the pathetic customer support they will assure that i will be receiving a call before 7.30 p.m. That day. However the cheating by e-bay continues. I received a mail yesterday stating that the claim adjuster had resolved my case and asked to give feedback to mr. Rizwan stating that he had sent me a mail on 15-09-2012.however no such mail is received by me nor any claim adjuster had called me. Another cheating tactic of e-bay. How can they solve it without any information to me. My claim adjuster mr. Kaustubh is sleeping for almost 50 days.


I have been cheated by ebay, its seller tablets_estore and iberry company. Please take necessary action so that other citizens are protected from these type of persons and companies.
