35,000/- LOST. Suspended account when raised claim. Review on Ebay

How ebay india scammed me Rs.35, 000/-

I had purchased a Sony playstation 4 from ebay india on 12 march 2015, It was delivered to me on 18 march with nothing inside the package but two half bricks and an old UPS battery.

I ALWAYS shoot unboxing videos of everything I buy online as a proof(doing this since last two years when snapdeal sent me wrong items), So I immediately took pictures of contents(bricks and battery) along with the unboxing video I shot. One thing I noticed was, the bricks were wrapped in newspapers and newspapers were used to fill the empty spaces in the box. These newspapers were published in lucknow ON 16-MARCH-2015. Which matches the day when parcel was lying in lucknow(from 15 to 17 march).

I contacted the seller and explained the entire matter, how(what it seems like) cheap courier he used had stolen the goods inside and replaced them with bricks and old battery. Seller asked me for photo and video which I provided. That was the last time I heard from him, He never replied to my messages or phone calls after this time.

I raised an ebay guarantee claim, Explained the entire matter along with links to pictures and videos of the contents inside.(including unboxing video I shot). Please note that I had raised the claim as “ITEM NOT RECEIVED” which is true considering the item(Sony playstation 4) I ordered wasn’t delivered to me. Besides I had explained the entire matter when I raised the claim.

But, to my surprise, ebay treated this matter as ‘undelivered parcel’ and asked seller to provide PROOF OF DELIVERY. They(what seems like) didn’t read what I had written when I raised the claim. I contacted customer care and told them that my issue is “PS4 wasn’t delivered to me, I got bricks instead”. They said they will provide these details to their guarantee claim team.

Seller provided Proof of delivery(signature of receiver) on 31st march 2015. And ebay suspended my account the next day(1st april 2015).

I contacted customer care, seeking for explanation for suspension of my account, They told me they periodically ask for proof of identity and proof of address from customers, and I will have to provide these to them(please note that I had provided these to them exactly one year ago on 28 march 2014 as well). I mailed them my proof of address and proof of identity and started waiting.

On 3rd april 2015. Ebay rejected my guarantee claim, saying since my account is suspended. I am not eligible for a refund.

What I can see here is a clear case of fraud. I provided all the evidence, yet ebay intentionally suspended my account to avoid returning the money I paid to them.

I am not going to let my hard earned 35k go due to fraud seller, courier or ebay whoever at fault is. I will raise this issue to consumer court and will sue them for their actions. I have already sent a legal notice to seller and ebay india giving them 20 days to respond with proper resolution.

BELOW MENTIONED ISSUES WERE WRITTEN EARLIER

I have 3 issues to report about Ebay:

1. I had a broken item shipped to me, Raised ebay guarantee claim. Settled in my favour. shipped the item back. Its been 10 months, No refund yet. I get no reply from their side when I ask for any update.

   
   




2. When I submitted my KYC documents, they took 16 days to reactivate my account. That too by constantly reminding them to clear my account as soon as possible.

   
   




3. They don't give sellers any powers against fraudulent buyers. Sellers can't even leave negative feedbacks to buyers. A buyer left me a negative feedback for no reason(saying "product is good" but still left negative). Ebay says they can't do anything.
