Hello Msians, I am writing diary after a months time sorry didnt got time nor had any gud topic in mind to share it in DP,


well few days back I read this in newspaper, n wanted to write over it.


Supreme Court ruling, that kicking daughter-in-law isnt a form of cruelty.


which further states that A husband and his relatives cannot be prosecuted for "cruelty" towards wife merely because the mother-in-lawor other family members had kicked her or for that matter threatened her with divorce.


Similarly, if a mother-in-law gives constant sermons to the daughter-in-law or allegedly treated her shabbily by giving her used dress suits, it does not invite prosecution under Section498A of the IPC. However, if the mother-in-law takes away the gifts given to the couple at the time of the marriage, it amounts to "breach of trust" as specified under Section 406 IPC


I was horrified to read that article kicking an animal is cruel, let alone kicking a daughter-in-law,.. Justices S B Sinha and Cyriac Joseph gave a seemingly irrational verdict. verdict such as this will provide legal rights to families all over the country whocontinue to harrass their brides/daughters-in-law. They will perhaps now add kicking to the repertoire of abuses heaped on the unfortunate women, believing it be condoned by none less than the apex court. Indeed a sad state of affairs.


The kind of law being practised in our country is really ambiguous.At one time we gather and say we all are Indians and should be treated equally and in the other hand we have different laws for hindus and different for muslims.More prevalantly in case of women rights laws are just kept aside for many silly reasons which just dont explain themselves. And here we have another one to add up to the fumes....In which law it is written that physical abusing or mental abusing isnot taken as a crime.Why should the law have such differentiation?. Going across once permission any kind of abuse is a crime.then how come KICKING OR THREAT is not considered in it. People's mind should change .Law should me made in favour of once right,once prestige.Not just amicably we will make the law without thinking about the state of people


The very fact that a mother in law hits her daughter in law brings forth the mentality of the mother in law & if a person can kick other person, she can at any time take the next step also which comes under "brutality" which may also further lead to murder.There is no end to behaviour of people with such mentality. If we justify such behaviour then we are inviting great trouble to our own culture & its anyways against humanity. I strongly condemn this decision of the bench of justices & request to treat such matters more on humanitarian grounds.


Msians, do share ur views over this SC rulling. Violence of any kind should never be tolerated. It goes against the fundamentals of justice.
