Cheated by eBay, No response from Customer Service

I had ordered HTC One v from ebay.in on 31st august, it was supposed to be delivered in 7 days and the seller finally shipped it after some reminders and I finally received it on the 8th of Sept.( If it hadn't been received by this date, ebay would have refunded my money for the purchase).


As soon as I opened the box, I found a STONE inside the box instead of the phone.


The same day I filed a claim with ebay, the claim id given to me was - 118974, they have something called "ebay guarantee" which states that they resolve claims within 20 days of filing.


I placed too many reminder calls to their customer service for some update on the claim, but the only update I got was on 21st of september - the claim adjustor told me that the claim would be resolved by 25th september.


Starting 24th sept I started calling ebay everyday for any further update, but the claim adjustor just didn't call back with any updates. I was given empty assurances by ebay india customer support - assuring me that I would get an update the same day or the next day.


Today (1st of Oct) they called me saying that the claim has been closed in seller's favor(after


23 days of filing it, 3 days more than the ebay guarantee and without any concrete fact finding at their end) - saying that "we trust the


seller and he has provided us documents which prove that he shipped the phone and you won't get your money back."


This really took me by a shock, and I decided to do some fact finding of my own, and I now have the evidence that proves that it was indeed


the seller who had shipped the stone -


The seller had used ebay's shipping service and sent me the shipping id - 4409388384

The shipping details mention the weight of the package as .27 kgs at the


source of shipment.

To further prove my case, I went to the market to a local mobile store shop


and weighed the sealed box of HTC One V, and it weighs approx .32 kgs.

*How can it be .27 kgs at the source of shipping if the seller hadn't put


the stone in the box? When the original phone box weighs .32 kgs*


HINT: The weight of the package is taken when it is submitted by the person who ships it!!!


The weight of the New Phone box is .32 kgs, when the details of origin show the weight as .27 kgs, how can ebay say that the seller shipped the phone?


How can a phone box that should have weighed .32 kgs turns out to be .27 kgs at the source and ebay still believes that it had the phone, can ebay now believe that it could have been a stone??


I want help from you in taking up this injustice done to me by ebay india.
