The state consumer disputes redressal commission (SCDRC) in an order has directed that Rs 16.45 lakh compensation be paid to a complainant for medical negligence. The order pronounced on May 2 was uploaded this week after a complaint filed by Goregaon resident Shyamalee Gupta. Gupta had made the ma...naging director of Lilavati Hospital and Research Centre and Dr. Ranjana Dhanu as parties alleging medical negligence. Gupta was suffering from menopausal bleeding and was advised to undergo minor investigative procedure - a hysteroscopy and dilation and curettage (D&C). On the same day she was readmitted due to continuous complaint of breathlessness. Her family members were informed that her right uterer was damage and emergency procedure called PCN was performed. She was told that to ensure right kidney is not damaged, another operation would have to be conducted. She was later admitted to Hinduja Hospital and her right kidney removed. Gupta sought damages of Rs 90 lakh (including medical expenses) stating that due to deficiency in service her right uterer was damaged and then right kidney was also removed. During the case, it was stated that during hysterocscopy, uterer was also removed. While giving the order PB Joshi, presiding judicial member and AK Zade, member of SCDRC found medical negligence. Their order stated: 'The question is about the reasonable degree of skill was to be exercised while doing the said process and it appears that no reasonable degree of skill was exercised while doing D&C. Reason is that, while doing D&C the right ureter was removed by opponent no.2 and hence, it cannot be said that it was an accident or misadventure.' The commission went on to direct that Gupta be given Rs 16.45 lakh as compensation which included Rs.3.63 lakh for medical expenses, Rs.1.90 lakhs for operation in Hinduja Hospital and Rs.91,800 for hiring of nurse and Rs 10 lakhs as compensation. Hi Smitha, Please do not expect kindly treatment from Dr. Hemant Mehta. He is going to treat you like a customer and would try to extract as much money from you as much it could be possible for him. Never ever trust Dr Hemant Mehta on any of the alternative treatment operations eg. Peritoneal ...Dialysis Catherter operation. He will try his best to screw up the operation so that the patient is not able to go for any other alternative treatment and returns to Hemodialysis. Thus he keeps on getting his weekly fees. Depending on the health of the patient, 3 dialysis per week could be needed. You are doing a great job in helping your mother. Hi Noblemen, I am sorry but I do not agree with your comments. In India a common person on the street is very much afraid to get involved in Legal cases including medical negligence. In India medical negligence is very difficult to prove because of corrupt legal system, cash rich doctors/hospitals a...nd communion of doctors. There is a legal provision (IPC Section 304A) for criminal prosecution in case of medical negligence. However not a single registered allopathic doctor has ever been convicted under this law in the history of Indian medico-legal jurisprudence until 1998. If you don’t believe me, please read the complete story (with legal proof) of what an India born American couple had to undergo from the hands of negligent doctors and corrupt legal system in India at the site: http://www.pbtindia.com/Anuradha_Story/ANURADHA_%20STORY_Home.htm I also do not agree with your second point about reputation of doctor. In India we do not maintain the history or success rate of a doctor. Its just word of mouth and the brand name of a hospital. I am not saying that all doctors in Lilavati are bad, I am just trying to make people aware of the bad ones. I request you to write a review about your bad experience in Pune hospital and make people aware of these criminals in disguise. Would just like to inform you that these doctors before kidney transplant told us that the operation wouldn’t be life threatening, worst that could happen would be that the transplanted kidney would get rejected and my mother would be back on dialysis. Keeping trust on this statement we went for the operation. One request: when writing comments to somebody’s review, esp. when the person has lost a life of his/her loved one, please don’t ask the person to “cool off”. It makes the other person feel that the person writing the comment is equally insensitive like the corrupt doctor or maybe is a marketing person of the hospital or the doctor himself. Read More
