I had signed up.for a money back plan with them on 2nd July for renting out my apartment in Sobha Petunia, Bangalore.It was a 50 days Money Back plan and the terms and conditions sent to me by email clearly stated that if they couldn't get me a tenant by 22nd August, the entire amount would be refunded.I was allocated a Relationship Manager( Ms KL Prathiba).This RM refused to upload about 52 photos of the property, I had sent to her by a link the reason -" I can't upload them.please send me screenshots of all the photos".I reminded her that all.these photos were from the Nobroker site and had the Nobroker logo embossed on them.They were used by my past RM's to rent out the very same property.She also wouldn't call me back whenever I tried contacting her .Anyway, finally, after about 3 weeks they put me on to a couple who seemed interested in renting out my apartment in Sobha Petunia.I had got offers from many other clients from other agencies but since this couple from Pune seemed very keen, I decided to rent out the apartment to them.However, it was mutually agreed between this couple and me that they would pay me a token advance of Rs 10000/- as a surety amount.This is because I had rejected many prospective tenants to accommodate their request.This amount would be forfeited in case they backed out of the deal and likewise if I backed out, I would give them double the amount ie 20k.This amount(10k)would of course be included in the deposit amount once the apartment rental lease was signed.We exchanged emails on this mutual understanding which was strictly between both of us and Nobroker agents were NOT involved in any way .This is a standard and accepted practice between lessors and lessees and I had adopted this practice for the last 15 years whilst renting out my apartments to tenants.Meanwhile, there were incessant calls from Nobroker agents who kept asking me if the deal was confirmed and if the lease was signed.I clearly told them to keep the property availability active on the site until the deal was signed. Unfortunately, these would-be tenants backed out a couple of days( on 27th July)prior to signing the rental agreement because of issues concerning their daughter's school.I then rang up Nobroker and updated them about this latest development The RM clearly told me that they had time until 22nd August to get me a tenant and they would keep the property active.However after about week when I hadn't heard from them I, realized that they hadn't bothered about activating the property and my RM clearly told me that since I had taken a token advance from the prospective tenants, I wasn't entitled to a refund on 22nd August(ie the Plan expiry date).I was shocked and told them that this token advance was an understanding strictly between the tenant and me and they were in no way involved.I also told them that the would-be tenants had willingly forfeited the amount because they had backed out of the Agreement and they never asked me to refund the amount to them because it was a mutual understanding between us.The Nobroker agents were clearly violating the terms & conditions of the Money Back plan because they had ceased looking for a tenant 25 days before the expiry of the Plan and refused to even refund the money.I escalated the matter to their Grievances officer and a Supervisor( Velmurgan) contacted me and assured me that he would look into the matter Later in the day another person( Rahul Das a Relationship Manager) contacted me and told that no refund would be given and that I was " confused".I read out the terms of the Money Back Plan refund policy and queried him if he understood what it meant.He obviously couldn't understand what I was trying to make him understand.
Fortunately, I have got a complete recording of all the phone conversations I had with the Nobroker agents and also have a record of the many emails exchanged between us.I will be filing a case in the Consumer court soon.
