I have purchased a Nokia 3120 classic mobile handset (IMEI No. 353101023712366) and the phone went out of order just 10 days of purchse. Since Nokia did not resolve the problem after reaped efforts by me, I have filed a case against NOKIA INDIA PVT LTD before the District Consumer Dispute Redressal Forum, Chennai (North) (CC No. 04/2009) under section 12 of Consumer Protection Act 1986.
The Judgment was received on 12.02.2010 in favour of me. The FORUM has clearly indicated the negligence of Nokia over consumer complaint and deficiency in their service. The FORUM come to the conclusion that the instrument purchased is having manufacturing defect and Nokia & the authorized service centre are negligent and deficiency in service in not rectifying the defect properly.
The FORUM directed Nokia to pay a sum of Rs. 7, 500/- towards cost of mobile phone with interest @ 9% from 04.07.2008 to till the date of Payment and also direct Nokia to pay a sum of Rs. 25, 000/- (Rs. 20, 000/- towards compensation for mental agony suffered by me due to negligence and deficiency in service and Rs. 5000/- towards cost of the court proceedings).
