Subject: Illegal Trading at eBay India

This is in reference to item number 200165330572

NEW BLACKBERRY 8700g SMARTPHONE BLUETOOTH EMAILING SET which was displayed on www.ebay.in by supplier smindia75 (http://myworld.ebay.in/smindia75/) on date 25th October 07. I purchased the same and paid money through paisa pay id 20606876064 to supplier. From that day my day of misery started.


          

Supplier sent me the product after some followup which I received on 31st October. Pickup date by courier was 29th October from the supplier and delivery at my end was made on 31st October however supplier had put wrong date as 25th October. No invoice was received with the product (copy enclosed Receipt1.jpg, Receipt2.jpg). While trying to activate the product I called up Airtel Customer care number 9845907070 however to my surprise they said that it is a used product and locked by O2 UK for non use in India. According to Airtel Customer care it is illegal to use O2 Blackberry phone as Airtel is the only supplier for the same (Handset PIN: 2500425B, IMIE: 357646.00.998654.7). We would like to confirm if you have purchased the handheld from Airtel or abroad as same is currently being used by O2 UK.


          

Please note that if a User ID is configured on any other service provider’s server, then you will need to contact that particular service provider, as we may not have access to other service provider’s database for deletion as it is illegal.

I promptly called supplier and informed him about the same. The same item was dispatched from my end very same day against docket number DO274680080WW (TNT Couriers, Delivery1.jpg, DeliveryLetter1.jpg). After further followup and further raising a dispute on ebay dated 7th November 07, to my relief supplier further dispatched another handset which was received at my end on 10th November 07. I again tried to call Airtel Customer care 9845907070 to activate the phone and use it, but to my biggest surprise again supplier had given me a used handset (Handset PIN: 2500425B, IMEI: 357646.00.998654.7). It was really bad as Airtel customer care wanted to know the location from where it was purchased. I further contact O2 UK to check if it is true and I got the following reply from O2 UK.

"If this device is registered to O2(UK), then you need to find out the username and password for the Blackberry account if you want to use it. You’ll only be able to use the Blackberry through O2 though as it’s registered with us. Please note it is against the user agreement to use it in any other country. If you have purchased the handset in India then we would like to know the reseller contant details and platform details from where it has been purchased."

Trying to resolve the dispute in good spirit, I further spoke to supplier and sent him the handset again for replacement against docket number DO 407 250 525 WW (TNT Couriers, Delivery2c.jpg, DeliveryLetter2.jpg).

After all this I thought now supplier will provide me with a new handset as promised in the display however on 12th November 07 supplier again posted a false message that he has dispatched the item but when asking for dispatch details he couldn’t provide anything. Till date nothing has been received at my end.

I want ebay to clarify the following points to me

1) Is ebay a place where illegal and stolen products are sold?

2)  Is eBay a place where customers are sold products so that they can get humiliated by service provider for using second hand products?

3) Is eBay a place which is encouraging supplier to sell products based on lies, inferior quality and mentality to cheat?

4) Is eBay a place to waste time and effort of the buyers?

I don’t have any desire to get a used/stolen/lost product further and I would like to have complete refund as well as compensation from the supplier for the putting me through the mental torture and causing trauma. I would like to have the compensation amount as 49100/- (13700 {Product Cost}, 400 {Courier Costs}, 15000 {Time wasted in transaction}, 20000 {effort wasted in transaction}). In absence of any satisfactory reply from eBay in next 7 working days, I will be forced to address the issue in necessary legal forum.

I hope eBay will stand up to its words for buyers and resolve the issue at the earliest.
